1. Agreement to Terms

By creating an account, downloading, installing, or using the Mind Awake application or website (collectively, the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

Mind Awake is operated by Jason Cassidy, a sole proprietor doing business as "Mind Awake" ("we," "us," or "our"). The App is available at mindawake.co and via the Apple App Store and Google Play Store.

2. Eligibility

You must be at least 13 years old to use Mind Awake. If you are between 13 and 18, you must have parental or guardian consent. By using the App, you represent that you meet these requirements.

We may ask screening questions during onboarding related to age, sleep health, and wellness history. These are designed to ensure safe use of the App and to customize your experience. Providing false information during screening may result in account termination.

3. Account Registration

You may create an account using email authentication or supported third-party sign-in providers. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You agree to provide accurate information and to update it as needed. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Description of Service

Mind Awake is an AI-assisted dream journal and lucid dreaming guide application. The App provides:

AI Guide ("Maya"): A conversational AI guide that teaches mindfulness-based lucid dreaming techniques and discusses sleep, dreams, and consciousness through text. Maya is artificial intelligence and is not a human.
Dream Journal: A tool for recording, organizing, and reflecting on your dreams.
Dream Imagery: AI-generated visual representations of your dream descriptions.
Milestones: AI-generated observations celebrating meaningful moments in your practice.
Curriculum: Structured lessons progressing from dream recall to advanced lucid dreaming practices.
Analytics: Personal dream pattern tracking and statistics.

We may add, remove, or modify features at our discretion.

5. Wellness and Medical Disclaimer

Mind Awake is a wellness and self-exploration tool. It is not a medical device, therapeutic service, or substitute for professional healthcare.

The App does not diagnose, treat, cure, or prevent any medical or psychological condition. The AI guide (Maya) is not a therapist, counselor, psychologist, physician, or licensed medical professional of any kind. Maya's responses are generated by artificial intelligence and should not be interpreted as medical, psychological, or professional advice.

Lucid dreaming practices may not be appropriate for everyone. If you have a history of sleep disorders, psychotic disorders, dissociative disorders, PTSD, bipolar disorder, depersonalization-derealization disorder, schizophrenia, or other significant mental health conditions, consult a qualified healthcare provider before using this App.

If you are experiencing a mental health crisis, please contact emergency services (911 in the US) or the 988 Suicide and Crisis Lifeline (call or text 988). The App is not a crisis service and Maya is not equipped to handle medical or psychiatric emergencies.

By using the App, you acknowledge that:

You use the App at your own risk
The techniques taught are for general wellness and self-exploration
You will consult a healthcare provider if you have concerns about how these practices affect your physical or mental health
AI-generated content may contain errors or inappropriate suggestions despite our safety measures
You are solely responsible for your own wellbeing and for discontinuing use if you experience adverse effects
The App's nightmare relief, sleep improvement, and lucid dreaming content is informational, not therapeutic

6. Subscription and Billing

Free Tier

The free tier includes: unlimited dream journal entries, a limited number of AI guide messages per day, and Foundation course content.

Pro Subscription

The Pro subscription provides: unlimited AI guide conversations with full memory across sessions, all guided lessons, AI-generated dream images, and advanced milestones and insights.

Pro is currently offered at $9.99 per month. Annual pricing may be offered at our discretion.

Billing

Subscriptions are billed through Apple's App Store, Google Play Store, or Stripe, depending on your platform of access. Payment is charged at confirmation of purchase.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current rate.

Cancellation

You may cancel your subscription at any time through your platform's subscription settings (Apple ID account, Google Play account, or Stripe customer portal). Cancellation takes effect at the end of the current billing period. You retain access to Pro features until that date. No partial or pro-rated refunds are provided.

Price Changes

We may change subscription prices with at least 30 days' notice. Price changes take effect at the start of the next billing period following the notice. Continued use of the subscription after a price change constitutes acceptance of the new price.

Refunds

Refund requests for App Store and Play Store purchases are handled by Apple and Google per their respective refund policies. We do not process refunds directly for those purchases. For Stripe-billed subscriptions, refunds are at our discretion.

7. AI-Generated Content

The App uses artificial intelligence to generate text responses, dream imagery, and observations. You acknowledge that:

AI-generated content may be inaccurate, incomplete, biased, or contextually inappropriate
AI responses do not represent the views or opinions of Mind Awake or its operator
We continuously work to improve AI safety, but no AI system is perfect
AI-generated dream images are artistic interpretations, not literal representations
The same input may produce different outputs at different times

We employ safety measures including crisis keyword detection, content filtering, contraindication screening, and wellness disclaimers. If you encounter content that seems harmful or inappropriate, please report it to support@mindawake.co.

8. User Content

Your Content

You retain ownership of all content you create in the App, including dream journal entries, text messages to the guide, and any community posts ("User Content").

By using the App, you grant us a limited, non-exclusive, royalty-free, worldwide license to:

Process your User Content through AI systems to provide the service (guide responses, milestone observations, image generation)
Store your User Content on our servers to deliver the service
Display User Content you choose to share in any community features to other users

This license terminates when you delete the relevant User Content or your account, except for backup copies retained as described in our Privacy Policy.

You may export or delete your User Content at any time (see Privacy Policy for details).

Public Content

Content you choose to share publicly within any community features of the App is visible to other Mind Awake users. You are responsible for what you share publicly. Do not share content that:

Contains personally identifiable information about others
Is sexually explicit, violent, or hateful
Promotes illegal activity
Harasses or threatens other users
Infringes on others' intellectual property
Constitutes spam or commercial solicitation

We reserve the right to remove community content that violates these guidelines and to suspend accounts of repeat violators, with or without notice.

9. Prohibited Uses

You agree not to:

Use the App if you are under 13 years old
Provide false information during onboarding screening
Attempt to extract, reverse-engineer, decompile, or manipulate the AI systems or any portion of the App
Use the App to generate content that is illegal, harmful, or violates others' rights
Attempt to bypass free tier limitations or access controls through technical means
Share your account credentials with others or allow others to use your account
Use automated tools, bots, or scrapers to interact with the App
Interfere with or disrupt the App's infrastructure or servers
Use the App for any commercial purpose without our written consent
Use the App in violation of any applicable law

Violation may result in immediate account termination and may give rise to civil or criminal liability.

10. Intellectual Property

The App, its design, code, AI prompts, curriculum content, and branding are owned by Mind Awake or its licensors. These Terms do not transfer any intellectual property rights to you.

"Mind Awake" and "Maya" are trademarks of Mind Awake. You may not use our trademarks without prior written permission.

AI-generated content (images, text, milestones) created through your use of the App is licensed to you for personal, non-commercial use. You may share screenshots of your own AI-generated content on social media with attribution.

11. Third-Party Services

The App relies on third-party services to function, including but not limited to:

Anthropic (Claude) for AI text generation
fal.ai (FLUX) for AI image generation
Neon for database services
Vercel for hosting and deployment
Stripe and/or Apple/Google for payment processing
Mixpanel for product analytics

These services have their own terms and privacy policies. We are not responsible for the availability, performance, or policies of third-party services. Service interruptions from third-party providers may temporarily affect App functionality, and we are not liable for those interruptions.

We may add, remove, or replace third-party providers at our discretion. The current list of providers is reflected in our Privacy Policy.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MIND AWAKE AND JASON CASSIDY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF SLEEP QUALITY, EMOTIONAL DISTRESS, ADVERSE PSYCHOLOGICAL EFFECTS, OR LOSS OF PROFITS ARISING FROM OR RELATED TO YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS RELATED TO THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Mind Awake, Jason Cassidy, and any agents or contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from or related to: (a) your use of the App, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any third party's rights.

14. Dispute Resolution and Arbitration

Informal Resolution

Before filing any formal dispute, you agree to contact us at support@mindawake.co and attempt to resolve the matter informally for at least 60 days.

Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the App that is not resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in California, or by remote/video proceeding at the arbitrator's discretion.

Class Action Waiver

YOU AND MIND AWAKE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

30-Day Right to Opt Out

You may opt out of this arbitration provision by emailing support@mindawake.co with the subject line "ARBITRATION OPT-OUT" within 30 days of accepting these Terms. Opting out does not affect any other portion of these Terms.

Exceptions

Either party may seek injunctive or equitable relief in a court of competent jurisdiction for intellectual property violations, unauthorized access to the service, or breach of confidentiality obligations. Either party may also bring an action in small claims court if the claim qualifies.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email at least 14 days before the changes take effect. Continued use of the App after changes take effect constitutes acceptance of the updated Terms. The "Last Updated" and "Version" fields at the top reflect the most recent revision.

When a new version is published, you may be required to re-accept the Terms to continue using the App.

16. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms, with or without notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including Limitation of Liability, Indemnification, Dispute Resolution, and Intellectual Property) shall survive.

You may terminate your account at any time by contacting support@mindawake.co or using the account deletion feature in the App. Account deletion is governed by our Privacy Policy.

17. General Provisions

Governing Law: These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Severability: If any provision is found unenforceable, the remaining provisions remain in full force and effect.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mind Awake regarding the App and supersede any prior agreements.
Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
Assignment: You may not assign these Terms. We may assign them in connection with a merger, acquisition, sale of assets, or formation of a successor legal entity.
No Third-Party Beneficiaries: These Terms do not create any third-party beneficiary rights.
Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.

18. Apple App Store Specific Terms

If you accessed the App via Apple's App Store, the following additional terms apply:

These Terms are between you and Mind Awake, not Apple. Apple is not responsible for the App or its content.
Apple has no obligation to provide maintenance or support for the App.
In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.
Apple is a third-party beneficiary of these Terms and may enforce them against you.
